1.    Our contract with you

Welcome to Sleep Unlimited Ltd.  By using this website to engage our services you confirm that you are 18 years of age or more, that any information that you submit as part of your assessment with us is true, accurate and complete and that you have read and agree to our terms and conditions and that you shall be legally bound by such terms subject to all applicable laws and regulations.

The terms ‘Sleep Unlimited’ or ‘us’ or ‘we’ refers to the company Sleep Unlimited Ltd, all its associated intellectual property including these web pages. The term ‘you’ refers to the customer of any information or services provided by Sleep Unlimited.

The usage of services provided by Sleep Unlimited are subject to the following terms of use:

Payment is required in advance of online services provided by Sleep Unlimited.

a)    Payment for treatment services and actigraphic assessment will be arranged with you at the time of booking and payment terms will be provided. Booking assessment or treatment services acts as agreement to payment terms.

b)    Cancellation of an appointment within 48 hours will be subject to a 50% charge of the appointment fee.

c)    All employees of Sleep Unlimited comply with

 i)    the British Psychological Society (BPS) Code of Ethics and Conduct

d)    Sleep Unlimited Ltd provides via its web site information, online assessment and reports with the aim of improving sleep through evidence-based self-management techniques. By accessing these services, you agree that it is your responsibility to choose whether to implement the advice we provide and you recognize that it is not always possible to completely resolve sleep problems although in the majority of cases improvements can be made. The information on our website and the advice in our reports is not intended to treat medical conditions or replace medical advice. You should seek advice from your GP for any medical or medication issues. As a result of your assessment findings we may suggest you seek medical advice and/or we may provide you with a letter for your GP. It is your choice and responsibility to follow our advice.

e)    The sleep-related clinical information provided by our website and associated services is evidence-based and is kept under review by Dr David Lee. We take care to ensure the information provided remains up to date, accurate and that it reflects clinically accepted good practice. In the event that we become aware or are alerted to any errors or omissions we will amend the information we provide as quickly as is practicable. However, to the fullest extent permitted by applicable laws, the authors, editors and publishers are not responsible for errors or omissions, or for any consequences arising from application of the information provided by our online services, and make no warranty, express or implied, with respect to the contents, completeness or accuracy of the material published.

f)    The information presented in this website is used strictly at your own risk.

a)    This website contains copyright material which is owned by Sleep Unlimited Ltd, and is bound by copyright law in England and Wales.

b)    You agree not to reproduce, duplicate, copy or re-sell any material on this website or that provided to you by Sleep Unlimited Ltd. You agree not to resell access to the online sleep assessment tools.

c)    The content of this website is subject to change without notice.

4.    Insurance

Sleep Unlimited has appropriate public and professional indemnity insurance.

5.    Privacy and Security

a)    Sleep Unlimited Ltd is registered with The Information Commission and will comply with client confidentiality as dictated by the GDPR (2018). We will keep the information you provide us with securely and we will not share any of your information with any other parties unless we have your consent to do so. Consent will be in writing or if taken verbally your consent will be recorded in writing by us.

b)    Details of your personal information which we hold about you are available to you on request under the GDPR (2018). If you would like a copy of the all the information held about you, please e-mail us at info@sleepunlimited.co.uk.  If you feel that any information we are holding on you is incomplete or incorrect then please email us and we will update our information held on you.

c)    We may use information that you provide to us for our own internal auditing purposes and to improve our services.  Any data that is published will be fully anonymised and we will ask you if you will be willing for your data to be used beforehand (including the use of quotes).

d)    All data that we collect from you will be used to ensure that our services to you are tailored to provide you with the best possible service.  Your improved sleep (or the sleep of your employees or clients) is our primary aim.

e)    Any services provided by another specialist not employed directly by Sleep Unlimited will be subject to their terms and conditions and Sleep Unlimited will not be responsible for any advice or additional services that they may provide to you.  Sleep Unlimited will not be responsible for any information provided by additional service providers (including those linked to this website).

f)    You understand that any information transmitted to us or our partners via any internet-based communication media may not be completely secure; and that you are aware of the risk of the potential for interception of information that you provide to us or our partners through the use of such media.  We exclude responsibility for any unforeseen information loss through the use of any internet-based communications media, any such loss or unforeseen disclosure is purely the responsibility of the customer.

6.    Your personal health responsibilities when using Sleep Unlimited Ltd services

If any of the following apply to you, we advise that you seek advice from your doctor before beginning implementing sleep improvement measures/recommendations,

a)    If you frequently fall asleep or struggle to stay awake during the day,

b)    If you are pregnant and experiencing issues with your sleep

c)    If you have a serious mental health condition

d)    Before beginning a new vigorous exercise programme

e)    If you are considering making any changes to prescribed medication you are taking

f)    If you have any other concerns or questions about your health or medicines.

Important notice – If you are finding that you fall asleep or struggle to stay awake during the day, you should not take risks by driving, operating machinery or other equipment.

7.    Online payment

Payments made via the Sleep Unlimited Ltd website are securely processed via PayPal. We do not store credit card details.

8.    Refunds

If you have purchased a service via our website you have the right to cancel your purchase within 14 days, provided you have not actually used the service.

If you wish to claim a refund for a payment made via the Website, you must inform us of this within 14 days of purchase by email to info@sleepunlimited.co.uk stating the reason for your refund request. You must include your full name, email address and date of purchase. On condition that you qualify for a refund under the terms set out here, we will send you an email confirming approval of the refund, following which payment shall be made within 30 days. Refunds will only be made to the PayPal account used in the original transaction.

9.    Breach of Agreement

a)    If a breach of this Agreement has occurred – which we will determine at our absolute discretion – we may take such action as we deem appropriate, which may include:

i)    Immediate, temporary or permanent withdrawal of your right to access the members area of our website.

ii)    Issue a notice to you to immediately cease and/or remedy such a breach.

iii)    Legal action against you.

iv)    Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this Agreement. The possible actions we may take on breach of this Agreement are not limited to those described here, and we may take any other action we reasonably deem appropriate.
